1. Who we are and what this is

Tiktok Pulse ("the Service", "we", "us") is a campaign monitoring, analytics and publishing panel for TikTok Shop sellers, operated by André Fogelman for agency clients. Contact: andre@anf.com.br.

The Service is a business tool. It is not affiliated with, endorsed by, or operated by TikTok Pte. Ltd. or ByteDance. "TikTok" and "TikTok Shop" are trademarks of their respective owners.

2. Who may use it

Access is invite-only. There is no public sign-up. Accounts are created by an administrator for the agency's staff and for authorized people at each client. You must be at least 18 years old and authorized to act for the business you represent.

You are responsible for everything done under your account, for keeping your credentials secret, and for enabling the second authentication factor where the Service requires it. Tell us at once if you believe an account has been compromised.

3. Connecting your TikTok accounts

The Service reads and writes data on TikTok only after the account owner authorizes it through TikTok's own authorization screen, and only within the permissions granted there. You may revoke that authorization at any time from your TikTok account settings or by asking us; once revoked, the Service stops reading and stops publishing for that account.

You confirm that you own, or are authorized to act for, every TikTok Shop and TikTok account you connect.

4. Publishing, and the human gate

The Service can prepare, schedule and publish content to a connected TikTok account. Nothing is published automatically. Every post is assembled as a request, shown in full to a human, and sent only after that person explicitly confirms it. Confirming is what states, to TikTok, that a human previewed the content and consented to publishing it.

You are responsible for the content you publish through the Service: that you hold the rights to it, and that it complies with TikTok's Community Guidelines, Advertising Policies and Terms of Service. TikTok may reject or remove content for its own reasons, and a post accepted by the Service is not a guarantee that TikTok will publish or keep it.

5. Acceptable use

You agree not to use the Service to:

  • access data of a shop or account you are not authorized to act for;
  • break TikTok's terms, scrape TikTok outside the official APIs, or attempt to obtain data beyond the permissions granted to us;
  • publish unlawful, misleading, infringing or deceptive content;
  • probe, overload or interfere with the Service, or try to reach parts of it that are not assigned to your role;
  • resell or expose the Service to third parties without our written agreement.

6. Data and privacy

What we collect, why, where it is stored and how long it is kept is described in the Privacy Policy, which is part of these Terms. Our security practices and how to report a vulnerability are in the Security Policy.

Data from a client is used only to operate the Service for that client. We do not sell personal data and do not use it for advertising.

7. Availability, and what we do not promise

We aim to keep the Service available, but we do not promise it will be uninterrupted or free of errors. The Service depends on third parties — notably TikTok's APIs — and those may change, throttle or fail outside our control. Maintenance may require downtime.

The Service is provided "as is". Figures shown are our best reading of what the source APIs returned; where a metric was not provided, the Service shows that it is missing rather than assuming zero. Business decisions taken from them are yours.

8. Liability

To the extent permitted by law, we are not liable for indirect or consequential damages, lost profits, or loss of data caused by third-party platforms. Nothing here limits liability that cannot be limited under Brazilian law, including liability for fraud or wilful misconduct.

9. Term and termination

Either side may end the arrangement at any time. We may suspend an account immediately if it is being used in breach of section 5, if it puts other clients' data at risk, or if a platform we depend on requires it. On termination we delete or export the related data as described in the Privacy Policy.

10. Changes

We may update these Terms. The date at the top always shows the current version, and material changes are announced to account holders. Continuing to use the Service after a change means you accept it.

11. Governing law

These Terms are governed by the laws of Brazil, and the courts of São Paulo, SP are competent, without prejudice to consumer protections that may apply.

Quem somos: o Tiktok Pulse é um painel de monitoramento, análise e publicação para lojistas do TikTok Shop, operado por André Fogelman para clientes de agência. Contato: andre@anf.com.br. Não temos vínculo com a TikTok Pte. Ltd. nem com a ByteDance; "TikTok" e "TikTok Shop" são marcas de seus titulares.

Quem pode usar: o acesso é somente por convite, não há cadastro público. Você responde pelo que for feito na sua conta, deve guardar as credenciais e ativar o segundo fator onde o painel exigir.

Conexão das contas: o painel só lê e só escreve no TikTok depois que o dono da conta autoriza, na tela do próprio TikTok, e apenas dentro das permissões concedidas ali. A autorização pode ser revogada a qualquer momento, e a partir daí o painel para de ler e de publicar.

Publicação: nada é publicado automaticamente. Todo post é montado como pedido, mostrado por inteiro a uma pessoa, e enviado só depois que ela confirma. Você responde pelo conteúdo publicado e por ele cumprir as diretrizes e políticas do TikTok.

Uso aceitável: é vedado acessar dado de loja que você não representa, burlar os termos do TikTok, publicar conteúdo ilícito ou enganoso, sobrecarregar o serviço, ou revender o painel sem acordo escrito.

Dados: o que coletamos e por quanto tempo está na Política de Privacidade, que faz parte destes Termos; as práticas de segurança estão na Política de Segurança. Dado de cliente serve só para operar o painel daquele cliente. Não vendemos dado pessoal.

Disponibilidade: buscamos manter o serviço no ar, mas não prometemos operação ininterrupta. Ele depende de terceiros, em especial das APIs do TikTok, que podem mudar, limitar ou falhar fora do nosso controle. Os números mostrados são a melhor leitura do que a fonte devolveu; métrica que não veio aparece como ausente, nunca como zero.

Responsabilidade: na medida permitida em lei, não respondemos por danos indiretos, lucros cessantes ou perda de dados causada por plataforma de terceiro. Nada aqui limita responsabilidade que a lei brasileira não permita limitar.

Encerramento: qualquer lado pode encerrar a qualquer momento. Podemos suspender conta de imediato em caso de uso abusivo ou de risco ao dado de outros clientes. Encerrado, os dados relacionados são excluídos ou exportados conforme a Política de Privacidade.

Alterações e foro: estes Termos podem ser atualizados, e a data no topo indica a versão vigente. Aplica-se a lei brasileira, com foro em São Paulo, SP.
